Chief Justice Martha Koome has appointed a three judge bench to hear the CBC petition.
In a circular send to newsrooms yesterday,CJ appointed Justices Hedwing Ong’udi ,Anthony Ndung’u and Anthony Mrima to hear the petition.
Earlier on Justice Mrima had referred the case to CJ koome to appoint a bench to hear and determine the matter since the petition had raised substantial issues.
The case was filed by a parent,Esther Ang’awa an advocate of the High court challenging the new Education system .The case by Ang’awa through the chair of LSK Nelson Havi urged the court to quash the new Education system and go back to the former system 8-4-4 system,saying the new curriculum is tiresome,costly and confusing for the teachers and learners. They further argued of the scarcity of resources and facilities that can make it a success.
The petitioners also argue that theĀ CS Education professor George Magoha and his team who are behindĀ the new system ,as unlawful and unconstitutional since they have not involved stakeholders and public participation has anchored in the law.
